چکیده
از آنجا که برخی رسانه‌ها، در فعالیت‌های خود مرتکب اعمالی می‌شوند که از لحاظ قوانین جاری کشور، جرم تلقی می‌شود، پرداختن به مسئولیت مدنی رسانه‌ها، نه تنها می‌تواند منجر به پویایی و رشد آن‌ها شود، بلکه سبب خواهد شد تا افراد زیان‌دیده از اقدامات رسانه‌ها، بتوانند راحت‌تر و شفاف‌تر خسارات وارده به خود را مطالبه کنند که نتیجه آن سوای از حفظ معنی واقعی آزادی بیان، رضایت‌مندی عموم مردم جامعه را نیز در پی خواهد داشت. هدف پژوهش حاضر مسئولیت مدنی رسانه‌های همگانی در قلمرو آزادی بیان با تاکید بر نظام حقوقی ایران میباشد که را روش توصیفی- تحلیل انجام شد. نتایج نشان داد که آزادی بیان در رابطه با رسانه اهمیت فراوانی دارد و مقنّن سعی کرده است که این دو مبنا را در مسئولیت رسانه‌ها در نظر بگیرد. نظریه تقصیر نارسایی‌ها نیز دارد به طوری که اثبات تقصیر در مواردی دشوار است و این باعث رنج زیان دیده است.

چکیده [English]
Because some media in their activities commit acts that are considered crimes according to the current laws of the country, dealing with the civil responsibility of the media can not only lead to their dynamism and growth, but will also cause people who have been harmed by the actions of the media , to be able to more easily and transparently demand the damages caused to them, the result of which, apart from preserving the true meaning of freedom of speech, will also lead to the satisfaction of the general public. The aim of the current research is the civil responsibility of mass media in the realm of freedom of expression with an emphasis on Iran's legal system, which was carried out using a descriptive-analytical method. The results showed that freedom of expression is very important in relation to the media and the legislator has tried to consider these two bases in the responsibility of the media. Theory of guilt
It also has shortcomings such that it is difficult to prove fault in some cases and this has caused the suffering of the victims.
